TuneSick is an wholly independent music streaming platform free from the conflicts of interests and influence of record label bosses, publishers and other shareholders alike. The TuneSick entity consists primarily, but not limited to the brands TuneSick Music, TuneSick Media, Reachify and SocialFlex. With offices in the UK and Nigeria, tunesick.app is operated and owned by TuneSick Music Limited – a company registered in England and Wales.
2- What personal data we collect and why we collect it.
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
By signing up on our website and uploading your content including your music, you give explicit consent for us to use your content solely for the purposes set out on this website. That is, for the purposes of the promotion of your music, events and the promotion of yourself as an artist as a whole. You consent to us displaying your content on our platform across all devices – desktop and mobile, across our network of partner sites and affiliates and across all our social media platforms.
If, for any reason you wish to cancel your account, you can do so with immediate effect, however, it can take up to 6 months for all music and music related content to be completely removed from the site. In some cases it may be that traces of your historical content may still appear and so we cannot always guarantee complete removal, however, we will always act upon any request to remove any unwanted content.
Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.
These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
3- Who we share your data with and how long we retain your data.
From time to time we use Google Analytics from Google on our web pages to create anonymous usage statistics. If you have concerns relating to the usage of Google Analytics be informed that it is possible to block Google Analytics by installing a plug-in to your browser. If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
4-What rights you have over your data.
If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
You can request a copy of your data at any time and we will happily provide them to you. There is no cost associated with this and you can do this as often as you want within a reasonable amount of time.
Once you register and sign up with us, you have the option to submit your music and upload it to our platform. Once submitted to us, you agree that TuneSick has ownership rights only to the purposes of sharing your music via the TuneSick website and associated social media platforms as described here and within our 'term's section.
You grant TS, royalty free worldwide license to use any photos, audio and moving content in relation to which you have responded in registering on our platform, hereinafter referred to as “Photos, Audio and Moving Content” for its marketing and/or in its advertising, including the online store, newsletters, email, social media – TS channels and paid social media, store materials and other customer communications. TS may use, reproduce, distribute, combine with other materials, alter and/or edit your Photos and Moving Content in its sole discretion.
You hereby represent and warrant that (i) you own all rights in and to your Photos and Audio, (ii) you have permission from any person(s) appearing in your Photos to grant the rights herein, and (iii) TS's use of your Photos will not violate the rights of any third party or any law. You hereby release and discharge TS from all and any obligation to pay you for any use of your Photos and any of the intellectual property rights contained therein in connection with the uses described above; and You hereby release, discharge and agree to hold TS and any person acting on TS's behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of the Photos and Audio as described above.
If for any reason you cancel or delete your account and want to remove your works, you must submit a removal request and we shall remove any work you want us to. This can take up to 60 days for us to completely remove all traces of work.
Only after 12 months from account cancellation / deletion – upon written request from the rights holder – can we guarantee that all musical works from the website and associated social media are fully removed.
Please note that small or fragmented historical traces or archives of the musical works may still appear on the website and related social media, if you notice any such content, please contact us with a removal request and we shall do our best to remove it.

TuneSick will not in any shape or form facilitate the infringement of copyright law or the misuse of intellectual property. If, at any stage, you feel that their is a piece of work that is rightfully yours and is being held on this site without your permission or without legal right then you must inform us immediately for us to take the appropriate action. If it is shown that there is work being held on our platform without legal right, we will move to take the said works down immediately. Please notify us in writing by sending an email to support@tunesick.app
We will respond to your complaint / submission within 48 working hours and once you have provided us with the necessary information the said works will then be subject to swift removal.
If I upload songs to TuneSick, do I still retain all the rights to them? Absolutely. TuneSick not a record label, publisher, agent or distribution company.It is a wholly independent streaming and sharing platform that allows users to sell and share their music online. There is no contract in place that restricts the distribution or promotion of your music and we do not have any ownership rights whatsoever. This platform merely acts as a host for your music, a gateway between you as an artist and listeners.
We do not charge any fees for using this service. Payments for streams are made directly to you or somebody you specify. A 20% commission is on downloads is taken as part of our service.

How we protect your data
Your data is stored and protected with rigorous standards to prevent or minimize any possible data breach. As part of our commitment to to privacy and data protection, TuneSick will not share your personal data with other organisations without your consent. We do not install tracking software on your device and will not send unsolicited mail to any user. We use appropriate technical and organisational measures to protect your personal data against unauthorized or unlawful processing and against accidental loss, destruction or damage. Our servers and websites are cloned and backed up on a daily basis; we also use servers across multiple providers to ensure minimal chance of data loss, hacking or breaching.
Account deletion: You may delete your account at anytime simply by visting the settings section when logged in. Alteratively you can request deletion simply by emailing us with the request and we will respond within 48 hours with confirmation.
Sensitive data is locked and access to such data is limited to only a small number of staff. All staff that have access to data undergo rigorous data protection training and are checked / vetted before any commencement of employment can take place. Computers are checked on a daily basis to avoid any misuse of data and customer records are never taken outside company offices.
The best way to avoid copyright infringement is to ensure that you don’t use anything created by anyone else. If you do use someone else's work, make sure you have the permission or right do so.

All songs uploaded onto the TuneSick platform should be copyrightedand registered with PRS, Sentric, ASCAP or any other relevant authority. It is your responsibility to ensure all songs uploaded comply with all copyright and licenscing and DMCA laws. If found to not be in accordance as such, we shall move swiftly to take down any unathorised content and disable your TuneSick account.
If there is to be found any content that is being used on the site without the owners' permission we will take it down swiftly. Users assume full responsibility and liability for all content uploaded on the platform. Our DMCA and complaints procedure exists to protect the legal rights of copyright owners and we strive to maintain our integrity as an ethical streaming and sharing platform.

At TuneSick we take intellectual property rights and copyright infringement very seriously, and will swiftly act to remove anything that violates such laws.
1. If you notice a track or song that is being used without yours or the rightful owners permission the first step to take is to contact the user who has uploaded the track. He or she may have some right either directly or indirectly.
2. If this is unsuccessful, you can simply visit the track in question, at the top of the track you will see a small 3 dotted line, simply click on this and then select ˜Report Copyright™. The necessary steps will then be taken to inspect the material and remove the track if it there without permission.

Please note: The music industry contains so many distributors and channels. Sometimes it can be that a user has permission either directly or indirectly, through another supplier or contact of some sort. It is sometimes the case that somewhere in the process of things, the user has sought permission either through an agent or some other intermediary. So it is always worthwhile to contact the original user first to check.
We will also ask for proof of ownership of the original track in the form of relevant documents. We will then take down any track that is proven to be in violation of DMCA / Copyright laws. Thank you.
